TERMS & CONDITIONS

Booking your Holiday

Your contract for your holiday is with iYaatra Holidays (referred to as 'the Brand'), registered in India as All Set Vacations LLP ('the Company'). Please carefully read and understand these terms and conditions before booking your holiday. All bookings are subject to the following terms and conditions:

1. Communication: The Company will send all communications regarding your holiday to the address provided on the booking form.

2. Booking Process: All bookings must be made through an authorized representative of the Company. To confirm your booking, you must complete and submit the Company's booking form along with a deposit of 50% of the total booking cost.

3. Booking Confirmation: Receipt of the deposit and booking form does not guarantee or imply confirmation of the booking. The Company will issue a written notice to confirm the booking. The Company reserves the right to refuse bookings without providing a reason and will refund any deposits received in such cases.

4. Payment: Full payment for your holiday must be made at least 30 days before the departure date. Failure to make payment by the due date may result in the Company canceling the booking and retaining the deposit. The person signing the booking form guarantees payment of the total amount shown on the booking form.

5. Special Requests: Any special requests, such as dietary requirements, should be noted on the booking form.

6. Service Delivery: The Company will provide the service as outlined and confirmed in writing.

Price Policy

7. Price Disclosure: The Company is not obligated to provide a breakdown of holiday costs.

8. Price Changes: The Company reserves the right to notify you of any price increases before accepting your booking.

9. Surcharges: After issuing a Confirmation Invoice, the price of your holiday may be subject to surcharges in specific circumstances, such as variations in transportation cost, fuel costs, airfares, taxes, fees, or government-imposed tax increases. The Company will absorb up to 2% of the holiday price (excluding insurance premiums and amendment charges) before passing on any surcharge to you. Surcharges exceeding 2% will be notified via a revised Confirmation Invoice.

10. Cancellation due to Surcharges: If a surcharge would increase the total holiday price by 10% or more, you may cancel your booking within 14 days of the revised Invoice's issuance and receive a full refund of all payments made.

Cancellation and Changes by the Company

11. Changes by the Company: The Company reserves the right to make changes to your holiday, which will be communicated to you as soon as possible. Major changes may include cancellations, airport changes, significant delays, or downgrades in accommodation.

12. Compensation: Compensation may be payable for major changes as specified below. No compensation will be provided for minor changes.

13. Force Majeure: Compensation will not be paid for changes or cancellations due to Acts of God (Force Majeure), war, civil unrest, terrorism, natural disasters, technical problems, airport congestion, strikes, adverse weather conditions, or events beyond the Company's control.

14. Cancellation by the Company: The Company may cancel your holiday at any time before the departure date, with a full refund of the money paid. No compensation will be provided.

15. Transportation Conditions: Transportation is subject to the carrier's conditions of carriage, which may limit or exclude liability.

16. Balance Payment: Failure to pay the balance of the holiday price at least 30 days before departure may result in cancellation by the Company, with applicable cancellation charges.

17. Refusal of Service: The Company reserves the right to refuse any person as a tour member if their behavior is deemed potentially hazardous or disruptive. In such cases, the Company's liability is limited to a refund of monies paid, minus fees for services used and administrative charges.

Cancellation and Changes by You

18. Cancellation by You: You may cancel your holiday by notifying the Company in writing. Cancellation charges are as follows:

          30 days or more: 50% of Deposit

          15 – 30 days: 50% of Tour Cost

           0 – 15 days: 100% of Tour Cost

          Or as specified in your final invoice

19. Amendments: After confirming the itinerary, one set of amendments is permitted free of administration charges. Further modifications initiated by you may incur an INR 2000 charge for communication and administration expenses.

Our Responsibilities

20. Third-Party Services: The Company does not own or manage the services (e.g., aircraft, accommodation, restaurants) used in tours. While care is taken in selecting providers, the Company has not necessarily inspected these services and does not represent them as inspected.

21. Liability: The Company is not liable for death, illness, or injury caused by failures or improper performance beyond our control. Clients are advised to have adequate travel insurance.

22. Unused Tickets: No refunds are provided for unused tickets (e.g., travel, sporting events) unless recoverable from the service provider.

Your Responsibilities

23. Travel Insurance: You are responsible for arranging travel insurance. Policy details must be provided on the booking form.

24. Travel Documents: Ensure all members of your party have valid passports, visas, and necessary documentation for the tour's countries.

25. Check-In: You are responsible for timely check-in and presentation for pre-booked components of your holiday. No refunds or credits for missed components due to late check-ins or lost travel documents.

26. Behavior: Clients must behave responsibly, respecting fellow travelers and the Company's reputation. Breach may lead to immediate termination of the holiday without further obligation.

27. Medical Conditions: Disclose pre-existing medical conditions on the booking form.

28. Luggage: All equipment and personal effects are at the owner's risk. The Company is not responsible for loss, damage, or delay unless due to our negligence.

29. Smoking: Smoking is prohibited in Company vehicles. Accommodation will be reserved with non-smoking rooms unless specified otherwise.

30. Waiver of Responsibility: Clients may be required to sign a 'Waiver of Responsibility' form acknowledging personal responsibility for their safety during certain tour activities.

31. Disclaimer: The Company makes reasonable efforts to ensure the accuracy of information on our website but disclaims responsibility for errors or omissions.

Complaints

32. Complaint Resolution: Report problems to relevant suppliers during the holiday and contact the Company office for assistance. Failure to report issues promptly may affect potential compensation. Submit written complaints within 28 days of returning home, including booking reference and relevant details.

Jurisdiction

33. Legal Jurisdiction: Any disputes will be governed by Indian law, and both parties submit to the jurisdiction of Noida Courts.

General

34. Booking Conditions: These booking conditions supersede any other warranties or conditions previously provided.
